What Happens if the Family Home is in Only one Spouse’s Name?

Many people have bought a home and then changed the title to be in only one spouse’s name in order to get a better interest rate.  Though beneficial in the short term, in the long term this exposes the other spouse to significant potential risk.  If the spouse whose name is on the title exercised no undue influence in the decision to change the title, then the other spouse could lose all ownership rights.  Absent a written agreement to the contrary, this can occur even if the spouse whose name isn’t on the title made all the payments for the home from their income.  Don’t let this happen to you; contact Sagaria Law today to schedule an initial consultation with one of our experienced, knowledgeable Family Law attorneys.
