What are the steps necessary for completing a divorce?

First the petition is filed by the Petitioner, and process is served on the Respondent.  After this, the respondent has 30 days in which to file a response.  Typically this is followed by one party filing for an Order to Show Cause where the judge will make rulings on temporary child custody, support, and restraining orders.  Next, the process of discovery occurs with Preliminary Declaration of Disclosure and Income and Expense Declarations.  After this, there will be either a Marital Settlement Agreement or a trial.  Finally, there will be a Judgment of Dissolution of Marriage prepared by one of the attorneys and a Notice of Entry of Judgment by the judge creating court orders from the Judgment of Dissolution of Marriage.  Call Sagaria Law today to schedule an initial consultation to learn more.
